Lawyers have argued she would be unable to get a fair trial in Orlando due to the widespread publicity of the attack.

However, federal justices are constitutionally required to hold trials in the same community where the crime occurred.

This is unless the accused can prove publicity was so inflammatory and prejudicial the community was saturated and an impartial jury could not be chosen.

‘The Court finds that the pretrial publicity in this case does not satisfy the prejudicial and inflammatory prong of the analysis, and the volume of coverage does not rise to the level of saturation,’ US. District Judge Paul Byron wrote in an order denying Salman’s request, according to the Orlando Sentinel.

Salman is being tried in a district that holds around 2.8 million people, so the judge denied the lawyers’ requests.

Attorneys will be using an unusual tool to ensure Salmon has a fair trial.

Potential jurors will be asked to fill out a questionnaire as part of jury selection before being chosen.

Salman’s trial is scheduled for March.
